POSITION REPORTS TO Component Three Lead
1. PROJECT BACKGROUND:
Through the USAID Transparent, Effective and Accountable Municipalities (USAID TEAM) activity in Kosovo, the DAI team is supporting USAID/Kosovo to address corruption at the municipal level by increasing the transparency and effectiveness of municipal procurement systems. DAI focuses on the following three program components:
a) Develop, refine and roll out models for transparent and accountable municipalities;
b) Engage the central level in addressing municipal corruption within the procurement process; and
c) Enable civil society to track and expose corruption.
DAI works extensively in five municipalities to champion anti-corruption reforms. In addition, DAI works with select entities within the Government of Kosovo (GOK) that are relevant to addressing corruption at the municipal level. Furthermore, DAI provides subcontracts or grants to national-level Civil Society Organizations (CSOs) to monitor all 38 municipalities in areas such as procurement and recruitment while ensuring greater citizen engagement.
2. ROLE’S PURPOSE:
The STTA will support USAID TEAM to build formal reporting mechanisms for CSOs and journalist to report cases of suspected corruption to the State Prosecutor. The STTA will advise and provide on-the-job coaching to CSOs and investigative media to prepare cases with hard evidence for the submission to law enforcement authorities. In addition, the expert will be responsible for ensuring that standards set by USAID TEAM are followed and project solutions are the most efficient and cost effective.
3. OBJECTIVES AND DUTIES
The main objective of this position is to provide advice and support to CSOs and investigative media to report cases of suspected corruption to the State Prosecutor by undertaking the following activities:
Draft an MoU that will be signed between the Office of the Chief State Prosecution and USAID TEAM partner CSOs. The MoU should outline formal mechanisms for CSOs and investigative media to pass on findings to the Prosecutor for further investigation;
Propose protocols of communication between CSOs and State Prosecutor;
Draft reporting templates/cover pages for reports of CSOs which are sent to the prosecutor;
Support USAID TEAM to host two events with CSOs, media and prosecutors from the basic courts and the Special Prosecution Office;
Provide on-the-job coaching to CSOs and investigative media to prepare legal qualifications and prepare cases with hard evidence for submission to law enforcement authorities;
Review the prepared cases and provide legal opinions concerning more complex issues;
Support CSOs to follow-up on the status of submitted cases by CSOs and investigative media with the Prosecutor.
Prepare draft MoU between CSOs and investigative media, and Office of the State Prosecutor;
Draft and submit reporting templates/cover pages for reports of CSOs which are sent to the prosecutor;
Organize two workshops with at least eight CSOs and media outlets who monitor procurement, and prosecutors from the basic courts and the Special Prosecution Office;
Reports from ten on-the-job coaching to CSOs and investigative media to prepare legal qualifications;
Review and provide legal opinions concerning 10 cases submitted to law enforcement authorities;
Report on any follow-up on the status of submitted cases by CSOs and investigative media to the Prosecutor.
Advanced law degree or equivalent to 5+ years’ work experience;
Prior experience with judicial and/or law enforcement institutions is required;
Prior experience with referral mechanisms is desirable;
Knowledge with work with CSOs and investigative media is desirable;
Experience with international donor projects in Kosovo is an advantage;
Good management, analytical, problem-solving, and communication skills.
