The Republic of Kosovo has received the financing from the World Bank toward the cost of the Kosovo Energy Efficiency Agency (KEEA) and it intends to apply part of the proceeds to payments for Consulting Services. The consulting services include: Options analysis, legal review, and development of model operational documents for EE investments through Energy Service Companies (ESCOs) in the public sector.
The Ministry Of Economy and Environment (MEE), Kosovo Energy Efficiency Agency (KEEA), Kosovo Energy Efficiency Agency (KEEA), now invites eligible consulting firms (“Consultants”) to indicate their interest in providing the services. Interested consultants must provide information indicating that they have the required qualifications and relevant experience to perform the services.
The attention of interested Consultants is drawn to paragraph 1.9 of the World Bank’s Guidelines: Selection and Employment of Consultants under IBRD Loans and IDA Credits & Grants by World Bank Borrowers, January 2011 (“Consultant Guidelines”), setting forth the World Bank’s policy on conflict of interest.
Consultants may associate with other firms in the form of a joint venture or a sub consultancy to enhance their qualifications.
DESCRIPTION OF THE ASSIGNMENT
This assignment comes under Component Two, Subcomponent 2B of the Kosovo Energy Efficiency & Renewable Energy Project.
Under the project, the World Bank will provide financing through KEEA for implementation of the project.
The objective of this assignment (the Assignment) is to support the Ministry of Economy and Environment (MEE) of Kosovo to develop an implementation plan to facilitate private sector involvement in the financing and implementation of EE projects in the public sector;
(i.) Develop an options paper to layout institutional, financing and contracting options of ESCO based EE investments in public sector. It shall include implementation mechanisms, roles and responsibilities of key players, financial aspects, selection criteria, contractual arrangements and procurement procedures, contract models, measurement and verification protocols, dispute resolution procedures, etc. The options paper should take into account Kosovo’s legal and regulatory environment and propose recommendations for policy development including possible legal and regulatory aspects/changes needed for implementation of the proposed options.
(ii.) Organize stakeholder consultations and roundtables to discuss the option paper and all its recommendations.
(iii.) Based on the stakeholders’ feedback on the options paper, draft a model operational document describing and detailing the proposed option. The document shall describe policy and regulatory framework, procurement procedures, models and types of contracts, measurement and verification protocols, dispute resolution procedures, environment screening and monitoring, typical EE measures, and all other relevant aspects of ESCO contracting for EE.
ACTIVITIES TO BE UNDERTAKEN
Task 1: Develop an ESCO options paper to layout institutional, financing and contracting options, legal and regulatory interventions needed, and contracting models to enable private sector implementation of EE projects in the public sector.
Task 2: Organize and deliver a stakeholder roundtable to present all options for ESCO contracting, based on comparative analysis, pros and cons, SWOT, risks, as well as necessary regulatory changes required for enabling the option.

The Consultant should be a consulting firm with relevant project experience. The work should be undertaken by a consulting team consisting of experts who have following skills and credentials.
The Consultant will comprise a firm having relevant experience in energy policy, energy efficiency, public procurement and public expenditure, carried out technical and financial energy studies; energy performance contracting and relevant financial and accounting practices. Strong local legal knowledge, as well as experience in Western Balkans and Energy Community countries best practices is required. Language skills in English and Albanian languages is required in specific the team of experts shall meet the minimum criteria’s;
THE EVALUATION AND SHORTLISTING CRITERIA ARE:
- Firm’s general experience in energy policy, energy efficiency (40%);
- Firm’s experience relevant to the assignment (feasibility studies; legal-regulatory improvement, public procurement, performance contracting, public expenditure, ESCO, local knowledge (60%).
Key expert 1. Task team leader/institutional expert. University degree in law, economics or engineering field;
- Min 10 years’ experience in energy efficiency policy development: legal, regulatory and technical
- Proven experience in being familiar with EED and EPBD requirements regarding application of energy performance standards and requirements, in particular on Energy performance/service agreement and
- Proven experience in developing studies on EE including investment projects for Energy efficiency
- Knowledge of English
Key expert 2. Energy efficiency expert. University degree in engineering;
- Min 10 years’ experience on energy efficiency (policy development: legal, regulatory or technical aspects).
- Proven experience in being familiar with EED and EPBD requirements regarding application of energy performance standards, Energy Auditing for buildings and industry, inspection of HVAC.
- Proven experience in developing studies on Energy efficiency, RES or developing investments/criteria for investment projects on Energy efficiency
- Knowledge of English
Key expert 3. Legal Expert. University degree in Law; 2
- Min 10 years’ experience in developing/ drafting legal and regulatory
- Experienced and familiar with the law on public procurement, public finances, public private partnership, public administration, tax, customs, local self-government processes,
- Knowledge of English
Key expert 4. Financial specialist. University degree in Finance or Economics;
- Min 10 years’ experience in financial and economic analysis,
- Experienced and familiar with the tax and customs administration, financial market, financial products,
- Good knowledge of local financial systems and
- Knowledge of English
Key staff will not be evaluated during shortlisting/evaluation of EoIs, but during contract negotiations. The first ranked firm will be required to provide candidates/key staff who fulfill the qualification requirements for the required positions as part of the technical/financial proposal.
The consultant shall propose necessary staff to fulfil all tasks described in the TOR, i.e. environmental, technical and logistics staff.
A consultant will be selected in accordance with the Consultants Qualification Selection (CQS) set out in the Consultant’s Guidelines.
