Background:

Since December 2019, only one of the two international lawyer’s posts have been occupied in the Office of Legal Affairs (OLA). OLA has engaged former OSCE officials with prior OMiK OLA experience on Short Term Assignments in order to address this challenge. Currently, OMiK is in the process of filling the two international lawyer’s posts within OLA, and this transition will involve unique challenges, following the upcoming departure of the current Head of OLA. In addition, a new Deputy Head of OLA is likely to be selected and on-board during a high-volume workload period, and will face a significant learning curve while acclimating to the unique legal and regulatory frameworks of OMiK. Thus, OLA requires the support of a special consultant during the transitional period before, during, and immediately after the Deputy is hired and a new Head of OLA is recruited. The consultant will assist in the on-boarding and acclimation of the new Deputy, offer expert advice relating to sensitive matters concerning personnel and potential appeals under Article X of the Staff Regulations and Staff Rules, and will be poised to advise on the Mission’s highly sensitive work with international justice tribunals should the need arise during the term of service. These are matters usually reserved for OLA’s international lawyers due to their sensitivity. The consultant may also be requested to travel for agreed-upon periods to the AoR to provide in-person legal services.

Objective of Assignment: 

The International Consultant will be required to assist in the on-boarding and acclimation of the new Deputy, offer expert advice relating to sensitive matters concerning personnel and potential appeals under Article X of the Staff Regulations and Staff Rules, and will be poised to advise on the Mission’s highly sensitive work with international justice tribunals should the need arise during the term of service.

Tasks and Responsibilities:

  • Provides legal advice, and supports the new Deputy in providing, analysis on the interpretation of the mandate of the OSCE Mission in Kosovo and compliance with the OSCE Common Regulatory Management System;
  • Provides legal advice, and supports the new Deputy in, providing and analysis in furtherance of all areas of the mandate of OSCE, inter alia, human rights, democratization,  media, elections, police training and with respect to the general applicable and applied law in Kosovo;
  • Provides legal advice, and supports the new Deputy in advising on the status and privileges and immunities of OMiK;
  • Provides legal advice and analysis, and supports the new Deputy in providing advice and analysis, on administrative matters ranging from contracts to international civil service law;
  • Drafts and reviews legal documents, including contracts, Memoranda of Understanding, Notes Verbales and correspondence, and related matters pertaining to proceedings before courts and other bodies in Kosovo;
  • Drafts and reviews documents and advises on matters related to OSCE Committees and Boards, including the Fund Material Management Committee and other committees and boards as established;
  • Assists in coordinating on legal matters with other international organizations, and other bodies or entities in Kosovo;
  • Transfers knowledge on the methods and protocols of OSCE Legal Services;
  • Assists in the assessment of back-rent claims against the Mission and advises on any settlement proceedings arising;
  • Assists in the assessment and clearance of OSCE material selected by the SPO;
  • Provides legal advice on interpretation of administrative guidelines, and the duty of care, in relation to COVID-19.
  • Performs other duties as assigned.

Deliverables:

  • Drafts legal documents, including contracts, Memoranda of Understanding, Notes Verbales and correspondence and related matters pertaining to proceedings before courts and other bodies in Kosovo;
  • Drafts documents and advises on matters related to OSCE Committees and Boards, including the Fund Material Management Committee and other committees and boards as established;
  • Drafts office on boarding document to assist the new Deputy upon on boarding.
  • Deliverables completed on time and as agreed with Head/OLA.

Performance Indicators:

  • Legal advice and analysis on the interpretation of the mandate of the OSCE Mission in Kosovo and compliance with the OSCE Common Regulatory Management System;
  • Legal advice and analysis in furtherance of all areas of the mandate of OSCE, inter alia, human rights, democratization, media, elections, police training and with respect to the general applicable and applied law in Kosovo

Necessary Qualifications:

  • Advanced degree in law
  • At least 10 years of relevant experience in legal services
  • Experience with an International Organization in the field of substantive legal services
  • Knowledge of international legal procedure standards and instruments
  • Demonstrable organizational, analytical, communication and interpersonal skills
  • Demonstrated ability and willingness to work with people of different cultural and religious backgrounds, different gender, and diverse political views while maintaining impartiality and objectivity
  • Flexibility and ability to work under pressure and with limited time frames

Remuneration Package:

Remuneration will depend on the qualifications and experience of individual experts as well as the detailed work plan to be agreed upon and will be based on the current OSCE consultancy rates.
